Terms of Service
Effective October 14, 2026
These terms govern the use of CarPencil (carpencil.com), operated by CarPencil, a U.S.-based company ("we"). By creating a store or using CarPencil you agree to them.
The service
CarPencil lets car dealerships prepare vehicle quotes ("pencils"), print them, and share them with customers as links or emails that report when they are opened.
Quotes are estimates
Every quote is prepared by the dealership named on it. Figures are estimates for discussion; financing and lease figures are on approved credit. A quote is not an offer of credit or a contract, and the final terms are those in the paperwork the customer signs with the dealership. CarPencil is not a lender, a broker or a dealer, and does not arrange financing.
Dealership responsibilities
- Check every quote before it reaches a customer, and keep the information you enter accurate.
- Only enter and share customer information you are permitted to use.
- When you send a CarPencil link by text message or email, you are the sender. You are responsible for the recipient's consent and opt-out handling under the TCPA, the CTIA Messaging Principles, CAN-SPAM and your messaging provider's rules.
- Keep your sign-in to yourself, and remove team members who leave.
Acceptable use
Do not use CarPencil to send spam, phishing or deceptive content, to impersonate another business, or to attempt to get around its security. We may disable links or accounts that do.
Plans and billing
The free plan includes 3 saved pencils. Paid plans are billed through Stripe at the price shown at checkout and can be cancelled at any time from the billing portal; access continues to the end of the paid period.
Your data
A dealership's quotes and settings belong to that dealership. You allow us to store and serve them in order to run CarPencil, as described in the Privacy Policy.
Disclaimers
CarPencil is provided "as is". Its calculations are tested against reference calculators, but you are responsible for verifying any figure before it is relied on. To the extent the law allows, our liability for any claim relating to CarPencil is limited to the fees you paid us in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules.
Changes
If these terms change, the new version will be posted here with a new effective date.
